The Western Cape High Court has passed a ruling allowing Cannabis to be used by adults in the privacy of their homes. This is a huge win for medicinal users.
A ruling in favour of private Cannabis use was announced this morning, during the midst of the Cabinet reshuffle the news seems to have been lost in the chaos.
This ruling means great things for people that use the drug for medicinal purposes, especially if they smoke the drug for pain management or as a sleep aid.
Cape Town – The Western Cape High Court has made a landmark ruling, declaring that it is an infringement to ban the use of dagga by adults in private homes.
In making the ruling on Friday, it has allowed for the possession, cultivation and use dagga at home, for private use.
The ruling has stated that the Drug Trafficking Act, as well as the Medicines Control Act must be ammended by Parliament within the next 24 months.
The application was to have the drug decriminalised, citing that the laws prohibiting Cannabis use were unfair, discriminatory, outdated, and applied disproportionately to black users.
The successful application to decriminalise Cannabis was driven by “Dagga Party” leader Jeremy Acton and Rastafarian Garreth Prince who argued on December 13 and 14 last year for the decriminalisation of the herb
The two have been helping people arrested for possession of Cannabis by obtaining a stay of prosecution, pending the outcome of their application.
